Why Abortion Should Be Legal?

Author's note: This article is a translation of another one I wrote this past June, when in Mexican Court the abortion bill was a matter of discusion. It was rejected, sadly, but now Trump is making abortion a topic worldwide. He's stopping the funding on all international organisations that support abortion ― even the WHO ― and that is making a huge damage all over the world. So, yes, I'm translating this. The article is deeply personal and it focuses on Mexico and latinoamerican countries more than anything, but maybe you can get my point. I know this blog main language is not English, but, for this post, it will be. Still, I'm going to re-post it in Spanish if someone is interested.

Nota de autor: Este artículo es una traducción de un artículo que escribí el pasado Junio, cuando en la Suprema Corte de Justicia se estaba discutiendo la ley del aborto. Lamentablemente, no fue aprobada, pero en este momento, Trump está volviendo la discusión del aborto algo mundial. Está deteniendo todo el financiamiento a todas las organizaciones internacionales que apoyen el aborto ―incluso la OMS y eso esta causando un gran daño en el mundo. Así que por esto estoy traduciéndolo. Este artículo es increiblemente personal y se enfoca en México y países latinoamericanos, pero quizá puedas entender mi punto. Sé que el idioma principal de mi blog no es el inglés, pero, por este post, lo será. Aun así, voy a repostear todo en español por si alguien está interesado. 



On June 29th ― just a few days ago [when I wrote the article] ― the Supreme Court of Justine in Mexico rejected the project that would have made abortion legal at a national level ― in other words: it would not have been an offense anymore. I would like to read the news the other way around and wake up knowing that Mexican women ― that can conceive ― could, at least, decide about their bodies and their pregnancies, so we could enter to the XXI century at last, but it was not the case. In Argentina, in the same days, a similar bill was being discused again and again. Maybe I have everything too clear and feel that is a topic that shouldn't be discussed anymore because it's ridiculous that someone tries to legislate a woman's body and, specially, her sexual and reproductive freedom... But the morality of abortion is grey, I'm writing this. Yes, I am pro-choice. 

El 29 de junio ―hace apenas unos días―, la Suprema Corte de Justicia en México rechazó el proyecto de amparo que pretendía despenalizar al aborto a nivel nacional ―o sea, que no fuera delito―. Me hubiera gustado que la noticia fuera al revés y despertar con la noticia de que las mujeres por fin pueden decidir sobre sus cuerpos en todo el país para entrar ya por fin al siglo XXI, que tanta falta nos hace, pero ese no fue el caso. En Argentina, por los mismos días, también se estaba debatiendo y volviendo a debatir. Igual yo lo tengo muy claro y siento que no se debería debatir más porque es ridículo que alguien pretenda legislar sobre el cuerpo de la mujer y sobre su libertad sexual y reproductiva… pero como la moral en la cuestión del aborto es más bien gris, me estoy molestando en escribir esto. Sí, estoy a favor del aborto.

Abortion in Mexico


[As this article is written by me, a Mexican woman, it's focused in my country] At a worldwide level, I'm going to show you how things are with a map, because, this time, I want to focus in Mexico. But if you're not from Mexico and you're interested in the topic, I explain below the arguments I have to believe abortion should be legal, so you can continue reading or go straight to that part. 

A nivel mundial, les explico como está la cosa con un mapa porque, por esta vez, quiero centrarme en México. Pero si no son de México y de todos modos les interesa el tema, más abajo expongo razones varias por las cuales considero que el aborto debería ser legal y otras cosas varias, así que pueden seguir leyendo (o saltarse esta sección).


In Mexico thigs are easy: you are in Mexico city, abortion is not a crime; you are not in Mexico city, it depends, but it's usually a crime. Well, thigs may seem easy but everything is a lot more complicated than it seems. On August 29th, 2008, the Supreme Court of Justice in Mexico said that abortion wouldn't be a crime anymore in the first twelve weeks of pregnancy. Since then, in Mexico City, 52.484 women have used voluntary contraception. 

En México la cosa es fácil: estás en la Ciudad de México, el aborto está despenalizado; no estás en la Ciudad de México, no está despenalizado. Bueno, la cosa de entrada parece fácil, pero es mucho más complicada de lo que parece. El 29 de Agosto de 2008, la Corte Suprema de Justicia de la Nación dictaminó que se despenalizaba el aborto durante las primeras doce semanas de gestación. Desde entonces, se han realizado 52.484 interrupciones voluntarias del embarazo en la Ciudad de México.

But not all Mexico is its capital and things in other states are completely different. Almost all states consider abortion as a viable option in case of rape, with the exception of Guanajuato, Queretaro and Guerrero. Some others just consider abortion as an option if the mother's life is in danger and in Yucatán you can consider it if you have no economic resources to bring up another child if you have three more. You see, not in every circumstance abortion is an offense, but still, we have a lot of restrictions. A lot of women travel all the way to the capital to get a safe abortion that doesn't put their lifes in danger; however, what happens with the rest of them that have no resources or even the information and wish to put an end to their pregnancies? Some of them raise unwanted childs ― some of them turn out right, some of them not ― and many others die in clandestine clynics. 

Pero no todo México es su capital y la cosa en otros estados es bastante diferente. Todos los códigos penales estatales consideran al aborto como una opción en caso de violación, excepto Guanajuato, Queretaro y Guerrero. Algunos otros sólo si la vida de la mujer está en riesgo y en Yucatán se consideran factores económicos si la mujer ya ha dado a luz a tres hijos o más. O sea, no en todas las circunstancias se considera un delito, pero igual hay bastantes reestricciones. Muchas mujeres de otros estados se trasladas hasta la Ciudad de México para poder practicarse un aborto seguro y que no ponga en riesgo sus vidas, sin embargo, ¿qué pasa con todas esas mujeres que no tienen los medios económicos o si quiera la información y desean interrumpir un embarazo? Algunas de ellas tienen un hijo no deseado, otras muchas mueren en clínicas clandestinas.

And don't dare to think abortion is something new at all. The first time the right to contraception was out in a feminist conversation in Mexico was in 1936, when a feminist grou presented a text titled "Abortion for social and economic causes". That was the first time that someone proposed making abortion legal in Mexican history. In 1976, women were already organising protests so all of them could go to the social health service ― yes, that's a thing here and it's "free" ― to get an abortion, ask for sexual and reproductive information and to get contraceptives for free for all the feminine population ― and today, I still have problems with the last one: they usually don't have anything for women available. 

Y no crean que el aborto es algo nuevo: la primera vez que el tema se planteó en México fue en 1936, cuando un grupo de feministas presentaron un texto titulado «El aborto por causas sociales y económicas». Esa fue la primera propuesta de la despenalización del aborto en la historia de México. Para 1976, se había iniciado ya una primera jornada para que las mujeres pudieran acudir a cualquier institución pública de salud a realizarse un aborto seguro exigiendo información y que les fueran proporcionados métodos anticonceptivos a toda la población femenina (aún hoy tengo un problema con ello: si tengo suerte en el IMSS, me dan condones femeninos porque milagrosamente tienen en mi clínica, si no, asumen que con unos masculinos me las arreglaré).

And if we talk about the numbers, you can consulte all the different statistics per state, age, occupation, religion and some other factors in Mexican goverment pages, Sadly, all that information is in Spanish, so instead you can try to look it up in your country. That would be easier for me if you want to know what's happening in your country. The only statistic you cannot usually see is the number of women that die in unsafe abortions, but I could locate that statistic at an international lever and this was what I found: 

Y si hablamos de los números, se pueden consultar diversas estadísticas por entidad federativa, edad, estado civil, ocupación, religión y otros factores más en esta página del Grupo de Información en Reproducción Elegida. Lo único que me faltó allí fue una estimación de la cantidad de mujeres que mueren cada año por realizarse abortos no seguros.Sin embargo, el Guttmacher Institute, realizó un estudio sobre el tema ―lamentablemente, a nivel internacional, no he encontrado datos sólo a nivel de México― y los datos que arrojó fueron los siguientes:



Traducción: (Título) Prohibir el aborto pone en peligro la salud de las mujeres. (Izquierda superior) Los embarazos no deseados son la causa de la mayoría de los abortos. (Izquierda inferior) 222 millones de mujeres en los países en desarrollo tienen una necesidad insatisfecha de métodos modernos de anticoncepción. (Centro superior) 47,000 mujeres mueren al año por complicaciones durante abortos inseguros. (Centro inferior). 86% de los abortos tienen lugar en los países en desarrollo, donde las leyes contra el aborto son mucho más restrictivas. (Derecha superior). Hacer el aborto ilegal no evita que ocurra, sólo obliga a las mujeres a hacerlo de manera clandestina e insegura. (Derecha inferior) Porcentaje de abortos que no son seguros en el mundo.

Why Abortion Should Be Legal?


The first reason is because women have the right to take decisions about their sexual and reproductive life, and about their bodies. However, most times they don't have the right to decide about their bodies, but also, they don't have the most basic information. In Argentina, the movement that is trying to make abortion legal has the following saying and I think that it's very important: Sexual Education to decide, contraceptives to not abort and legal abortion so we don't die. I have the luck ― and the privilege ― to have Sex Ed in middle school and the program that time was really good, imparted by police women ― mostly, I remember a man somewhere ― and I had the best teacher I could ask for; I've been always thankful for that, because it has given me all the wepons to defend myself in these topics and to demand the right to decide about my body. But for that moment on... In the hospital I'm assinged in my social health insurance program is not a single method of contraception for women and they mostly ask me to go with my doctor because bureacracy is hell. So, imagine the situation for women that are not as privileged as I am. 

La primera, es porque las mujeres tienen derecho a decidir sobre su vida sexual, reproductiva y sobre su cuerpo. Sin embargo, muchas veces ya no sólo les falta el derecho a decidir por su propio cuerpo, sino la información más básica. La consigna del movimiento que busca el aborto legal en Argentina es la siguiente y me parece muy importante: Educación sexual para decidir, anticonceptivos para no abortar, aborto legal para no morir. Yo tuve la suerte y hasta el privilegio de que mi escuela secundaria formó parte de un programa de la policía para dar clases de educación sexual y que mis clases de educación sexual fueron impartidas, creo, por la mejor policía del planeta; siempre he agradecido eso porque me dio muchas de las armas para defenderme en estos temas y para reivindicar mi derecho a decidir sobre mi cuerpo en pleno conocimiento. Pero de ahí para adelante…: en mi clínica jamás tienen anticonceptivos gratuitos para mí como mujer, conseguir pastillas me obliga a ir a una cita carísima con el ginecólogo porque la burocracia en el seguro social me deja muerta. Ni que decir de las mujeres que están en una posición aun peor que la mía.


The second is because no contraceptive method ― with the exception of abstinence  ― is 100% safe. You don't remember Ross in Friends, completely appalled because he didn't know that condoms were only 97% safe when Rachel told him they were going to have a baby? And in case you are from another planet and don't know friends, just ignore the reference. But let's make it clear: no contraceptive method is 100% safe. Obviously, the posibilities of end up pregnant if you use some method are much more less, but still, the posibility is there. It exists. So, before telling a woman to stop fucking around, remember that even when they use contraception, women can end pregnant. And remember, also, that there a lot of them that are not in your situation and don't have your life and much less that privilege that you have to get contraceptive methods or even the information about them. 

Porque ningún método anticonceptivo ―con la excepción de la abstinencia― es 100% seguro. ¿No recuerdan a Ross en Friends, consternado porque no sabía que los condones no eran 100% efectivos cuando Rachel le dijo que tendrían un hijo? Y en caso de que sean de otro mundo y no vean Friends, ignoren la referencia. Dejémoslo claro: ningún método anticonceptivo es 100% seguro. Obviamente, las posibilidades de embarazarte si tomas pastillas, si tu pareja usa condón o si tienes un DIU, etcétera, son muchísimo menores que si no te cuidas, pero igual, la posibilidad existe. Así que antes de decirle a una mujer que «debió cuidarse», recuerda que aun usando métodos anticonceptivos, pueden quedar embarazada. Y recuerda, también, que hay muchas mujeres que no están en tu situación ni tienen tu vida y mucho menos ese privilegio que tienes tú de poder acceder a métodos anticonceptivos.

The third one is because women are not asking permition to abort: they do it even if it's a crime and some of them die because they did it unsafely. I would have loved to find the statistic in Mexico, but Argentina is the closest example I have right now and there more than 100 women die every year because they are victims of unsafe abortions and many endure complications. And in general they are poor women, because the ones that have the economic resourcer go to safe places to abort. The women who decide to terminate their pregnancies are not asking for anyones permission to do is, whether it's safe or not. Legalize it is a way to prevent all the deaths. 

Porque las mujeres no le están pidiendo permiso a nadie para abortar, abortan igual y algunas de ellas mueren por hacerlo en lugares clandestinos. Me hubiera encantado encontrar los datos en México, pero Argentina es lo más cercano que tengo ahora mismo, allí mueren más de 100 mujeres al año por abortos inseguros y otras tantas más son tratadas por complicaciones después de un aborto. Y en general son mujeres pobres, porque las mujeres con los medios van a otros lugares a abortar. Las mujeres que abortan no le están pidiendo permiso a nadie a la hora de tomar la decisión, las ponga en riesgo o no. Legalizarlo evitaría todas esas muertes.

The fourth one is because maternity should be a free choice. Women have to have to power to decide about their maternity and their bodies. Maternity is not destiny. We are not machines to procreate or have children. Of course, here it comes that awful question: "and what about men?"; no, I haven't forgotten about them. Paternity should be also a free choice and, in many cases ― not every case because each one has a different story ― it is. How many men don't abandon their responsabilities with their childs when they are in front of an unwanted pregnancy? How many women are raped and have children of a rapist that, of course, it's not going to show up in their lifes and be a father? Women suffer inequality because they cannot disappear.

Porque la maternidad debe ser de libre elección. Las mujeres tienen que poder decidir sobre su cuerpo y su maternidad. La maternidad no es, en ningún caso, destino. No somos máquinas de crear hijos. Por supuesto, aquí viene esa irritante pregunta de «¿y los hombres?»; no, no me he olvidado de ella. La paternidad debe también ser de libre elección y, en muchos casos ―no todos, cada quien tiene una historia diferente― lo es. ¿Cuántos hombres no abandonan su responsabilidad con sus hijos al enfrentarse a un embarazo no deseado? ¿Cuántas mujeres no han sido violadas por un agresor que probablemente no vuelvan a ver en su vida y, además, terminan embarazadas? Las mujeres sufren de desigualdad aquí porque para ellas no es tan fácil como simplemente desaparecer.


And the last one is because legal abortion it's not a ethic debate anymore, it's politic. Ethics are personal. That's why it's said that, if you consider abortion unethical, just avoid having one. Ethics are individual. For good or bad, everyone make the decisions about their lifes. 

El aborto legal ya no es un debate ético, sino que es político. La ética es de cada quien. Por eso se dice que si alguien no considera el aborto como ético, no aborte. La ética es individual. Para bien o para mal, cada quien decide sobre su propia vida.

Saying "a child is going to transform your life" doesn't work. Maybe I don't want a child transforming my life. Maybe I want to wait. Maybe a child transform my life, but for the bad. Mayve I was raped and I don't want this child tranforming my life. Maybe I was using contraciptive methods, so you can get I don't want a child right now. The reasons that are here in this post, aren't the only ones that exist. There are thousands. There's a reason to abort that is completely valid per woman in the world who have aborted. 

Decir «un hijo cambia la vida» no cambia nada. Igual y yo no quiero que un hijo me cambie la vida. Igual y quiero esperar otros años más para que un hijo me cambie la vida. Igual y un hijo me la cambia, pero para mal. Igual y me violaron y no quiero que este hijo me cambie la vida. Igual y estaba usando métodos anticonceptivos, por lo que se entiende que no quiero que este hijo en especial me cambie la vida. Las razones que he dado allá arriba no son las únicas que existen. Hay miles. Hay una razón para abortar completamente válida por cada mujer en el mundo que ha abortado alguna vez.


Every woman that has aborted has a different story, most of them don't fit in the narrative of the irresponsible woman who didn't take care of herself ― how many lack of access to basic sex ed information in the world? ― and opened her legs ― when, if you end uo pregnant, you need a man participant. Every woman who has taken this difficult decision deserves to be heard because each one of them has a different reasons and different stories. The numbers, like the ones in this post, can help us to be more practical and see what's the most viable solution, but at the end of the day, all women who had teminated their pregnancies are people and deserve more than be just a number. Their stories deserve to be heard and taken in account.  

Cada mujer que ha abortado en el mundo tiene una historia, la mayoría no encajan en esa historia única de la mujer irresponsable que no se cuidó ―¿cuántas no tienen acceso a información de cómo cuidarse en el mundo?― y que abrió las piernas ―cuando para acabar embarazada, hace falta que un hombre participe―. Hay que escucharlas a todas, porque todas tienen razones distintas e historias distintas. Los números, como todos los que presenté arriba, pueden ayudarnos a ser prácticos y a ver cual es la solución más viable, pero al final del día, todas las mujeres que han abortado en el mundo son personas y se merecen mucho más que ser parte de una fría estadística. Se merece que su historia sea oída y tomada en cuenta.

    Me encanta este blog porque me va a permitir leer más en inglés. El artículo en general trata un tema a la orden del día y sumamente interesante. Por falta de tiempo no he podido leerlo entero, pero volveré para terminarlo. Gracias por explayarte tanto con un tema tan importante.

    Excelente post!
    Estoy de acuerdo con tu postura, de hecho, acompañé a mi pareja a la marcha del #8M acá en Argentina (desde mi lugar, obvio).
    Recién se está debatiendo en el Congreso la despenalización del aborto... aunque lamentablemente muchos pensamos que no va a pasar, porque nuestra sociedad no está preparada para abrir la cabeza y los ojos (asimismo los políticos que ocupan tranquilamente sus bancas). Pero siempre iremos adelante por más conquistas. Por lo que corresponde.
